Everett Shipyard Inc
Background
The Everett Shipyard site (Site) sits along Everett’s waterfront within the Port of Everett’s (Port) North Marina Redevelopment Project. From 1947 to 2009, ESY, Inc. (previously Everett Shipyard, Inc.) and its predecessors used the site as a boat building, maintenance, and repair facility. This included marine vessel repairs, tank evacuations, equipment disassembly, sandblasting, woodwork, metalwork, painting/coating, and mechanical repairs. ESY, Inc. leased most of the upland portion of the site.
Soil, groundwater, and marine sediment samples tested from the 1980s to 2007 contained measurable levels of contaminants. Primary contaminants found in the uplands include metals, polycyclic aromatic hydrocarbons (PAHs), petroleum, and marine paint additives such as polychlorinated biphenyls (PCBs). Marine sediment samples were contaminated with various semi-volatile organic compounds (SVOCs) including PAHs, tributyltin (TBT), PCBs, petroleum, and other metals.
Status
In 2012, Ecology and the Potentially Liable Persons (PLPs), the Port of Everett and ESY, Inc., entered into a Consent Decree (CD), a legal document for site cleanup. A cleanup action plan was developed for the site and a final remedial action was selected.
During in-water cleanup in 2014-2015, crews found several unexpected obstructions. Ecology ultimately determined the obstructions next to a bulkhead prevented full removal of contaminated sediment. The obstructed areas were capped with clean material, and future in-water activities will be limited to prevent recontamination of the site. The upland cleanup at the site was completed in 2014. The marine sediment cleanup was completed in 2015. In 2016, the Cleanup Action Plan (CAP) and Consent Decree (CD) were amended to reflect these changes to the cleanup approach; these amendments were finalized in 2017.
The cleanup included demolishing the facility buildings, excavating and offsite disposal of approximately 20,000 cubic yards of contaminated soil, dredging and offsite disposal of approximately 15,000 cubic yards of contaminated sediment, and demolishing the marine railway, docks, and other structures.
Now that cleanup is complete, the project has moved into its monitoring phase. The site conditions will be evaluated periodically (every five years) to ensure that the cleanup remains successful. The most recent periodic review happened in 2023; the next one is planned for 2028.
- April 2008: Ecology enters into an Agreed Order (AO) with the Potentially Liable Persons (PLPs) – the Port of Everett and ESY, Inc.
- November 2008: The Remedial Investigation and Feasibility Study (RI/FS) work plan is finalized and approved.
- December 2008-April 2009: Initial Remedial Investigation data (soil, groundwater, and sediment samples) are gathered.
- February-March 2011: A draft RI/FS and draft Public Participation Plan (PPP) are released for a 30-day public review and comment.
- May-June 2011: The final RI/FS is released in May, followed by the response to public comments on the draft RI/FS in June.
- November-December 2011: The Proposed Consent Decree (CD), draft Cleanup Action Plan (CAP) and State Environmental Policy Act (SEPA) Determination of Non-Significance are released for public review and comment. The response to public comments is released in February 2012. See the “Summary to Public Comments” below under Site Documents.
- 2012-2015: Upland and in-water cleanup is completed. From the uplands, about 20,000 cubic yards of contaminated soil is removed and 8,400 tons of concrete and asphalt is recycled for use as road base. For in-water cleanup, about 15,000 cubic yards of sediment is dredged, and several derelict structures are removed and replaced by a new bulkhead.
- October-November 2016: A draft Amendment to the CAP and draft Amendment to the CD are released for 30-day public review and comment.
- February 2017: Amendments to the CAP and the CD were finalized.
- January 2023: The Department of Ecology conducted a Five-Year Period Review of conditions at the site. Monitoring data found that the cleanup actions continue to be protective of human health and the environment, and that no additional cleanup is needed at this time.
- May 2023 – June 2023: The draft Five-Year Periodic Review is released for a 30-day public review and comment.

Site use restrictions called institutional controls are in effect
Institutional controls can be fences, signs, or restrictions on how the property is used. For instance, an institutional control may prohibit installing drinking water wells or disturbing a protective cap that isolates contamination. These restrictions keep the contamination contained and keep people from being exposed to the contamination. The controls are usually listed in environmental covenants recorded with the county.
Periodic reviews are required when institutional controls are required at a site. Ecology conducts reviews to make sure the controls remain effective and the cleanup still protects human health and the environment. We conduct periodic reviews about every five years.
